International law, and (now) custom holds most culpable the instigators of Aggressive War.
In fact, due to precedence (and logic), generally, a victim of Aggressive War gets to get away with a lot of bad things in self-defense because 'that which is necessary for survival is legal'.

It would be fair to say I know a little bit about International Law, and the Law of War. All commissioned and non-commissioned officers in the the US armed forces are responsible for knowing the basic Laws of War, the high points of the Geneva Conventions, and the Hague Conventions as well as US laws and the Uniform Code of Military Justice.

If switzerland is under siege for *years* by the fictional East Ameristan until their food is depleted, then is suddenly attacked by East Ameristan, and the swiss (being swiss) magnificently rout the besieging invaders and capture millions of enemy troops in the process, obviously they can't *feed* all the the captured troops. Their own people are starving.
It is their legal responsibility to care for the POWs, but it is not the fault of the swiss it is the fault of their enemy that the POWs cannot be fed, after all it is the *enemy* who starved the Swiss, and it is the enemy who attacked the swiss.
Is there a larger and moral legal obligation than the Geneva Conventions?
Does one have a larger moral and legal obligation to:
1. Give quarter to surrendering enemies?
2. Feed the enemy who starved you, while your own people are starving?
3. Defend your nation, feed your people, THEN feed your enemy?
In actuality, under International Law, that the Swiss starved prisoners of war may not even be a 'Grave Breach' because it was not done *willfully*.
They had no food to give, so that none was given wasn't intentional/willful.
Yet another common example on how INTENT is very much a measure of the 'blame' in moral and legal evaluations of conduct.
The Swiss could have chosen instead to:
1. Kill surrendering troops (a grave breach as it is willful).
2. Starve their own people (a breach of international law as well, but not of the Geneva Conventions, and common sense dictates non-combatants are cared for first).
3. 'Parole' the enemy, only to face them again (no breach of international law, but a breach of survival).
The least of the evils contemplated is to accept the surrender of the enemy, as at least some may live, rather than kill the enemy in cold blood.
National survival is the very basis of national sovereignty, and national sovereignty is the guiding principle of International Law.

That being said, as you say, victors are generally the ones who hold trials, and a nation's leaders must survive before being held accountable by international tribunals.
The United States and Nazi Germany practices unlimited submarine warfare during WW2.
Admiral Doenitz (sp) was NOT prosecuted for this Crime Against Peace, not because it was legal, but because his attorney claimed that which was practiced by the victors should not be the basis of crimes for the losers. UK and USA practiced unlimited submarine warfare.
Due to his defense while the charges stood, his punishment was not based on this crime. He was the highest-ranking NS tried, convicted, who also kept his life. Doenitz received 10 years in prison.

'Black Gang Territories' - this isn't a movie. Self-identified Black people make up <10% of Angelinos. Hispanics and Latinos (not all Mexican, admittedly) make up 51% of Los Angeles.
In the year 2012, there were about 300 murders (I forget, I've cited this before) in Los Angeles.
That same year about 100 pedestrians were killed in traffic accidents, and for all of California about 3000 people were killed in traffic fatalities (I can't find the number for Los Angeles specifically but California had a population of about 35 million, Los Angeles, 3.5 million).
SO, about as many people died in traffic fatalities in Los Angeles as died from homicide. Now what you reasonable people must keep in mind is that some traffic fatalities ARE homicides (so this 300 is part of the 300 homicides in LA 2012) but none of the gun murders from the Great Black and Brown Race Wars are included in the traffic fatalities, unless K. alleges that angelinos are smashing their cars into each other with murderous intent in order to hold down their corners.

Reasonable people would tend to disagree with 1 and 2, rather than accept the correlations and the extrapolation.
Reasonable and Skeptical people would check 3-4 (my assertions) then go and check 1 and 2 - because it is unlikely that if 1 and 2 are true the correlations and extrapolations are valid.

Rather than disprove the premise I incorporated much of it into my argument, then added additional premises, among them: Homicides are down year by year in LA, crime in Detroit is largely not racially motivated, but Detroit is far more homicidey, and is much closer to an international border than Los Angeles.
And from these premises one strong correlation is that with the rise in gangs there is less homicide in Los Angeles.

Yugoslav Partisans were like NVA in Vietnam War. You couldnt kill them or defeat them as you didnt know where they are. Captured yugoslavs in combat ended up dead from torture but still didnt gave away their comrade positions. War could last few more years without a problem, YP numbers would grow every day. You do know already YP liberated Yugoslavia alone without external help. Though USSR sent army from romania and bulgaria to ''help'' in Beograd. Stalin wanted USSR's name to be in history books when liberation of eastern europe happened, so he sent Red Army to Yugoslavia, but those 100 tanks and 5000 troops werent needed.
They took Belgrade easily. The Yugoslavian army had traitors, the Croats preferred the Germans than the Serbs.

I didnt say yugoslavs killed million germans every year, but germans sent milliion soldiers more every year to crush partisans. Read carefully before you post.
well, then the whermacht would've had 4 million-400.00=3.6million soldiers in yugoslavia, don't think udssr would've won then...

i agree with you, but you agree that 3.6million soldiers is a bit too much? 
also i'm really scared by the fact that...
you are right that yugoslavia was full with enemys of germany, but that also means that the only way for hitler to conquer this (what he really wanted)
was to kill all this people. that like justifys the holocaust D= but then again...don't piss off poles and other eastern europeans xD
